RESOLUTION No. 2021-07

A RESOLUTION CONCERNING VACCINE MANDATES

WHEREAS, the elected office holders in Baca County, Colorado swear an oath to uphold the US and State Constitutions; and
WHEREAS, there is no Constitutional authority to restrict individual unalienable rights; and
WHEREAS, Baca County respects the unalienable right of citizens to make their own choices concerning their healthcare, bodies, and well- being; and
WHEREAS, demanding employees divulge their personal medical information invades their protected right to privacy, and discriminates against them based on their perceived medical status, in contravention of the Americans with Disabilities Act. ( 42 USC § 12112( a).); and
WHEREAS, the Board of County Commissioners of Baca County are tasked with protecting the employees of Baca County from unreasonable orders and with providing a cooperative and productive working environment; and
WHEREAS, Baca County does not have the resources to enforce State and Federal Mandates, and does not intend to use its very limited resources to enforce any vaccine mandates issued by either the State of Colorado or the United States Federal government, and would encourage all elected officials to refuse to require or to enforce the same.
BE IT RESOLVED that the Board of County Commissioners of Baca County go on record to oppose vaccination as a condition of employment for County employees.
BE IT FURTHER RESOLVED, that the Board of Commissioners of declare that it has no intention of using limited county resources to enforce any vaccine or mask mandate, and would encourage all elected officials to refuse to require or enforce the same.
